Counsel for all-time great professional athlete sued by former personal trainer for defamation in New York federal court regarding our client’s adamant denials that he ever used performance enhancing drugs. After the district court granted, in part, Mr. Clemens’s motion to dismiss and counsel successfully obtained third party discovery in contentious proceedings, the litigation shifted to a war over privilege assertions. The litigation was ultimately resolved in a settlement which did not require Mr. Clemens to pay his former trainer even $1.

Defense counsel for large homebuilding company and land developer in an arbitration proceeding initiated by a homeowner claiming construction defects to their home. After Mr. Hollingsworth took the deposition of the homeowner’s expert witness, the plaintiff dropped their claims and the case was dismissed.

Defense counsel for investment banking and brokerage firm responding to subpoena for records and grand jury investigation brought by U.S. Department of Justice Antitrust Division related to the actions of an individual employee and alleged destruction of records. After leading an internal forensic investigation and meeting with prosecutors, the Justice Department indefinitely deferred any grand jury appearances and proceedings.

Plaintiff’s counsel for Major League Baseball agency injured when several employee agents left to join a competitor. After a five-day confidential arbitration hearing before the MLBPA, the case was favorably resolved for a confidential sum.

U.S. v. Clemens

Defense counsel for all-time great professional athlete prosecuted for perjury, obstruction of Congress, and false statements in connection with U.S. Congressional investigation of the use of performance enhancing drugs in Major League Baseball. The federal government deployed over 100 law enforcement officers and reportedly spent over $120 million to try to make an example of Mr. Clemens. The first federal jury trial ended in a mistrial after prosecutors violated a pre-trial ruling we won. The second federal jury trial lasted ten weeks and resulted in a complete acquittal of Mr. Clemens on all six criminal counts.

Trial counsel for Harris County Commissioner in investigation and subsequent charges for federal programs bribery, tax evasion, and false statements to the F.B.I. A three-week federal trial resulted in a hung jury and mistrial. The Commissioner resolved the charges against him by pleading to the false statements charge and was sentenced to probation.
