Dial Corporation v. Sel-Leb Marketing, Inc.

Lead Counsel for the plaintiff in a trademark infringement lawsuit brought in New Jersey federal court. After extensive discovery and depositions of the infringing parties, the parties agreed to injunctive relief and the case reached a favorable confidential settlement for Dial.

Budiman, et al. v. Academy Development, Inc., et al.

Business Litigation Construction

Co-lead trial counsel for large homebuilding company and land developer sued in Fort Bend County over allegations made by subdivision homeowners regarding alleged defects to an amenity lake. After a four-week jury trial, the jury returned a verdict in favor of the developer.



Texas v. Calvin Murphy

Criminal Defense Sports Litigation Athletes, Agents & Teams

Trial counsel for NBA Hall of Fame former Houston Rocket Calvin Murphy, who was charged with aggravated sexual assault and indecency with a child. After a five-week jury trial, the jury deliberated for under two hours and acquitted Mr. Murphy on all counts.

Defense counsel for Anthem Insurance Company and WellPoint, Inc. in several lawsuits consolidated in U.S. federal court brought by a class of hundreds of thousands of health care providers against the major health insurance companies in the United States over billing and administration practices. Mr. Monthy supervised a nationwide document and data collection effort and was one of a handful of attorneys for all defendants tasked with analyzing and seeking expert opinions regarding procedure and device coding software and systems for use in the litigation. Anthem/WellPoint reached a settlement in July 2005, which was lauded by the industry and shareholders as a commercial success.


Flaherty v. Legum & Norman Realty, Inc.

Catastrophic Injury Environmental

Counsel for plaintiff who contracted Legionnaire’s disease after exposure to bacteria in condominium building’s potable water system. After a federal district court granted defense motions striking expert microbiologist testimony and granting summary judgment, Mr. Monthy argued to the Fourth Circuit Court of Appeals that the rulings did not propoerly weigh guidelines in accepted trade publications. The matter was successfully settled for a confidential sum.

Counsel for dental provider in years-long internal and professional investigation. The client and the Texas Health and Human Services Commission reached a favorable settlement, resulting in no charges being filed.


Confidential: Association of State Hospitals

Emergency Litigation Health Care

Plaintiff’s counsel for association of state hospitals interested in challenging the legality of a Medicaid assessment. After emergency litigation preparation and advocacy, the proposed assessment was successfully amended by state authorities.
