Criminal Defense Sports Litigation Athletes, Agents & Teams

Trial counsel for NBA Hall of Fame former Houston Rocket Calvin Murphy, who was charged with aggravated sexual assault and indecency with a child. After a five-week jury trial, the jury deliberated for under two hours and acquitted Mr. Murphy on all counts.

Defense counsel for Anthem Insurance Company and WellPoint, Inc. in several lawsuits consolidated in U.S. federal court brought by a class of hundreds of thousands of health care providers against the major health insurance companies in the United States over billing and administration practices. Mr. Monthy supervised a nationwide document and data collection effort and was one of a handful of attorneys for all defendants tasked with analyzing and seeking expert opinions regarding procedure and device coding software and systems for use in the litigation. Anthem/WellPoint reached a settlement in July 2005, which was lauded by the industry and shareholders as a commercial success.

Catastrophic Injury Environmental

Counsel for plaintiff who contracted Legionnaire’s disease after exposure to bacteria in condominium building’s potable water system. After a federal district court granted defense motions striking expert microbiologist testimony and granting summary judgment, Mr. Monthy argued to the Fourth Circuit Court of Appeals that the rulings did not propoerly weigh guidelines in accepted trade publications. The matter was successfully settled for a confidential sum.
